Motorized Bikes and Mopeds

Helmet Law Requirement for Persons Under Age 18
Effective July 1, 2007

 
Effective JULY 1, 2007, all operators or passengers on motorized bicycles or motorcycles under the age of 18 MUST wear a helmet.

This law prohibits a person under 18 years of age from operating or being a passenger on a motorcycle or motorized bicycle unless he or she wears an approved helmet that is properly secured with a chin strap. The law creates a Class A traffic violation punishable by a $100 fine, a $15 surcharge and 3 points against a persons driver's license if convicted.  The law requires an additional $10 surcharge per violation to be deposited in the Colorado Traumatic Brain Injury Trust Fund.
 

Commodity Metals - Effective July 1, 2007

 
This law requires a buyer of commodity metals to record the seller's identification and the law specifies what qualifies as sufficient identification.  It requires  the seller to provide a statement to the buyer indicating where the seller obtained the metal that is included in the purchase record.  It creates  a Class 2 misdemeanor if the value of the commodity metal involved is less than $500 or more; defines "metal" if the commodity metal has a value of $.50 (Fifty Cents) per pound or greater for the purposes of recycling the commodity metal.  The law excludes beer kegs.
 

Residency Requirement for Concealed Weapon Permit Reciprocity
Effective July 1, 2007

 
This law clarifies that a concealed weapons permit is good in Colorado only if the permit and the person's residence ID are from the same state.  The law allows a person who is establishing residency in Colorado 90 days to comply and obtain the permit.
 

Choice of Alcohol Testing Method on a DUI Stop
Effective July 1, 2007

 
This law explains that a law enforcement officer, who has requested that a suspected drunk driver take a test to determine blood or breath alcohol content, may require the driver to take a test other than the one they selected - if the officer determines that there are extraordinary circumstances that prevent timely completion of the chosen test.  The driver's failure to comply shall be considered a refusal to submit to testing.  The law defines "extraordinary circumstances" as those beyond the control of the officer, including weather-related delay, power outages, malfunctioning equipment and high call volume, but expressly excludes officer convenience.
