Choice of Alcohol
Testing Method on a DUI Stop |
|
| This law explains that a law enforcement officer, who has requested that a suspected drunk driver take a test to determine blood or breath alcohol content, may require the driver to take a test other than the one they selected - if the officer determines that there are extraordinary circumstances that prevent timely completion of the chosen test. The driver's failure to comply shall be considered a refusal to submit to testing. The law defines "extraordinary circumstances" as those beyond the control of the officer, including weather-related delay, power outages, malfunctioning equipment and high call volume, but expressly excludes officer convenience. | |
