IMMIGRATION REPORTING REQUIREMENTS

 

 

Effective July 1, 2006, the Colorado State Legislature passed Senate Bill 06-090 (SB 90), which is related to Colorado Revised Statute 29-29-101.  SB 90 requires local governments to take certain affirmative steps to enforce federal law related to immigration.  The purpose of the bill is to prevent cities from enacting "sanctuary policies" which permit illegal immigrants to reside in Colorado.  The statute requires that police officers who have probable cause that a person arrested for a criminal offense is not legally present in the United States, to report such person to Immigration Customs & Enforcement (ICE).  If the arrestee is held at a detention facility, the reporting duty becomes the sheriff's responsibility.  Additionally, the reporting requirement does not pertain to those arrested for domestic violence unless the person is convicted of the charge.

Fort Morgan's City Council adopted a resolution in accordance with (Senate Bill 90) which states that it is the duty of officers of the Fort Morgan Police Department to cooperate with state and federal officers regarding immigration laws and to comply with the reporting requirements to the General Assembly and United States Immigration and Customs Enforcement.
